Email template to cancel a listing agreement with your real estate agent

You signed a listing agreement, the contract that gives one agent the exclusive right to sell your home for a set period, usually six months to a year. Now you want out before it expires. Maybe the agent has gone quiet, the photos never got taken, or your plans changed and you are no longer selling. A phone call gets you a sympathetic "let me see what I can do" and nothing on paper. The agreement is a written contract with the brokerage, not the agent personally, so the release needs to be written too. This email asks for the release, names the reason plainly, and asks for one thing that matters: written confirmation of any fees you still owe.

Before you send

  • Your copy of the listing agreement. Find the end date, the cancellation clause, and any line about a cancellation fee or "protection period" (a window after cancellation during which you still owe commission if you sell to a buyer the agent introduced).
  • The name of the brokerage and its managing broker. The broker, not the agent, usually has to sign a release.
  • Your reason, in one or two neutral sentences. You do not have to justify yourself, but a clear reason makes the broker more willing to let you go without a fee.
  • Dates of anything that went wrong: missed showings, unanswered messages, listing not posted. Facts, not feelings.
  • What you want to happen next: a full release, or a switch to a different agent inside the same brokerage.

I'm writing to ask that we cancel the listing agreement for [property address], signed on [date signed], effective as soon as possible.

The reason is [I've decided not to sell for now / the home has been listed since date and has had little activity / I'd like to move in a different direction with the sale]. I appreciate the work you've put in, and I'd like to end this on good terms.

Could you please:

- Send me a written cancellation or release signed by the brokerage
- Confirm in writing whether any fee is owed, and if so, how it is calculated under the agreement
- Confirm whether a protection period applies and, if so, list the buyers it covers
- Remove the listing from the MLS and any websites once the release is signed

I'd like to have this settled by [date, about a week out]. If the brokerage needs a form from me, please send it and I'll return it the same day.

Everything in brackets is yours to fill in. Keep the rest as it is or change the tone to match how you write.

After you send

  • A reasonable brokerage sends a one-page release within a few days, often with no fee if the home has not gone under contract. If they ask for a fee, ask them to point to the clause that allows it.
  • Watch for a "conditional withdrawal" that pulls the listing but keeps the contract alive until the end date. That leaves you unable to list with anyone else. Say no and ask for a full release.
  • If the agent does not answer within a week, send the same email to the managing broker directly. Their name and email are on the brokerage website.
  • If the brokerage refuses outright and the agreement has real problems on their side, your state's real estate commission handles complaints against licensees. Mention that only after the polite path has failed.
